Posts for February 18, 2016
These are the posts that are accumulated in our newsletter which goes out every 4-6 days during the school year. The posts are organized by the major units in our Con Law (5th ed.) student textbook.

I. Introduction to Law, the Constitution, and the Supreme Court [See TOPICS 1-10 in the 5th edition of Constitutional Law] Here are some recent articles that are relevant to this unit:

Deadlocks and Rearguments: What's Ahead for the Supreme Court [NY Times, 2/18/16]: What lies ahead for the Supreme Court when it returns to the bench on Monday, a week after the death of Justice Antonin Scalia?

FERC v. the states -- Round 2 [SCOTUS blog, 2/17/16]: The line that supposedly divides the nation’s energy suppliers between the regulatory reach of the federal government and that of the states has long been blurred, but no more so than in recent years, with a shift to giant regional markets using very arcane mechanisms on pricing and supplies that seem to affect everyone in the industry.  The states have grown fearful that the dividing line is now shifting more to the federal side — and, so it did, about three weeks ago in a Supreme Court decision.

In Defense of Justice Scalia on Religious Liberty and Smith [Justia, 2/18/16]: Professor Hamilton discusses the Court’s decision in Employment Div. v. Smith, in which Justice Scalia wrote for the majority holding that a law is constitutional under the Free Exercise Clause of the First Amendment if it is facially neutral and generally applied.
But see Charlie Haynes’ piece: “Justice Scalia’s Disastrous Decision on Religious Freedom” [Newseum, 2/18/16]:
