Who Gets to be Human? [Justia, 10/21/15]: Margulies continues his discussion of the role of dignity as a condition of a legitimate criminal justice system. Margulies argues that it is dignity that saves us from the conceit that we may decide who gets to be human, but he laments that many people are not yet ready to give up that conceit. 

Scalia: 'Wouldn't surprise me' if death penalty struck down [AP, 10/20/15]: Scalia addressed capital punishment during a University of Minnesota Law School appearance Tuesday. Scalia says death penalty decisions from the court have made it "practically impossible to impose it, but we have not formally held it to be unconstitutional."

Friedrichs v. CTA – What you need to know about challenge to union dues [EdSource, 10/20/15]: Sometime in early 2016, the U.S. Supreme Court will hear arguments in Friedrichs v. the California Teachers Association et al., a closely watched California-based lawsuit with major implications for the state’s teachers unions and potentially all public-employee unions. The lawsuit challenges the authority of the CTA and other public-employee unions to collect mandatory fees, a main source of their income and, by extension, their power.

EU rights court allows secret hearings [Jurist, 10/20/15]: The European Court for Human Rights dismissed the claims of three students claiming their nearly two weeks of detention without charges violated their human rights. 

San Francisco Affirms Sanctuary City Status [Two articles from CNS, 10/20/15]: The San Francisco Board of Supervisors on Tuesday unanimously approved a resolution opposing the "scapegoating of immigrants" and rejecting a "deportation-focused" federal immigration program. Meanwhile, Senate Democrats blocked a bill Tuesday that would defund so-called sanctuary cities - jurisdictions that ignore federal detainers on immigrants whom the government seeks to deport.
